Microsoft set to screw retailers on behalf of manufacturers using pirated software

It’s going to be tough time soon for all the vendors in U.S selling products which arrive from manufacturers who use pirated software copies of any of Microsoft’s product. It’s extremely difficult for Microsoft to go around the world and sue companies using pirated software because different laws prevail. Well, once they themselves got fined $16,000 for trying to sue pirates in India.

Microsoft is now trying to get a bill passed in the Legislature which will hold the retailers responsible for the pirated softwares being used by their manufacturers, be it in any part of the world. So if a retailer in New York is selling watches coming from China and the manufacturer at China used a pirated copy of MS Excel to send details about the products being shipped, definitely the retailer is in trouble. Once the bill is passed, Microsoft will be able to drag that retailer into the courtroom and sue him for his manufacturer.

They really hope to curb down piracy with this move. But I think this could definitely have some varied effects on the market. This bill is already facing some stiff opposition in the U.S.

Microsoft fined $16000 for suing Indian software pirates : weird but justified

India is a country where anything can happen. I really did mean “anything”.

Software piracy if on fifth gear in India and the main targets are obviously Microsoft products. Microsoft isn’t happy with them at all.

microsoft

Recently it filed a case against the software pirates from Bangalore, Hyderabad, Chandigarh and Mumbai at Delhi for using their software without proper legal permission.

What you think would have happened – Those pirates got fined and are leaving a good life now.

What happened – Microsoft got fined and had to pay $4000 to every one of the defendants of the case i.e  4 defendants X 4000 =  $16,000

Delhi High Court had fined Microsoft because it thought Microsoft was using its cash flow to harass the Indian pirates who had to come all the way from different cities to Delhi, the national capital to defend themselves while the cases could have been solved in the local courts also.

What Microsoft did was not illegal but as per Justice Dhingra’s comment,

When the constitution of India provides equality before law, this equality has to be all pervasive and cannot be allowed to be diluted because of money power or lobbying power,

Now this is called a fair decision.

bittorrent
For People who beleive that Internet is a place where you have right to share everything, or you are supporter of PirateBay, then this one’s a must read.

Comedian Louis CK’s Stand up Performance had been put up on BitTorrent. So what did Louis do next?

Made a Request stating -

HI. I’m Louis CK. Can you please take this down? This show is a work in progress and was not intended to be passed around the internet. I have absolutely no problem, personally, with file sharing, and if you take everythign I have on the market on DVD, CD, and put it up for free downloading, I don’t care. But this is an artistic and personal request. Please take this torrent down. thanks.

Next, now what Response he receives -

Sorry Mr. CK, I have taken down the direct downloads and asked Mininova and ViPeers to remove the torrent. I thought you would have preferred the reverse, your live concerts in ****ty audio quality would be ok, especially for what you said about NBC taking down your Late Night appearance, and your high quality DVDs and stuff wouldn’t be ok since you need ***** for that stuff. I sincerely apologize for the torrent and the misunderstanding.

Well, this is a very good effort by Louis. Well, it was a smart decision made by him, instead on knocking the doors of the court. Well Done.
